Essential Influencer Contract Clauses
A bad contract will tank your ROI even if the creator's content is incredible. If you leave out usage rights, you are renting views for 48 hours. If you include them, you are buying an asset.
1. Whitelisting (Dark Posting) Rights
What it is: The right to run paid ads through the creator's social handle.
Standard term: 30 days included in the base fee, with predefined renewal rates (e.g., +15% fee per additional 30 days). Vital for TikTok.
2. Content Usage Rights
What it is: Where else you can use the video (your website, your organic socials, email newsletters).
Standard term: Perpetual organic usage on owned channels. Paid usage (running ads from your brand handle) usually limited to 3-6 months. Track where you use it.
3. Exclusivity
What it is: The creator cannot promote a competitor.
Standard term: 14 days before and 14 days after the post goes live. Pushing for longer will significantly increase the base rate.

4. Approval & Revisions
Always mandate written approval of the script/concept before filming, and at least 2 rounds of minor editing revisions. If they film something off-brand without an approved script, you shouldn't have to pay for a reshoot.
